01. What is the information channel?

It is a tool that allows you to confidentially communicate knowledge of potentially irregular activities or conduct that may be an infringement in a work or professional context.

02. What is the regulatory framework for the channel?

The regulations that regulate the operation of this channel are Law 2/2023, of February 20, 2023, regulating the protection of people who report regulatory and anti-corruption violations.

This Law transposes European Directive 2019/1937 of the European Parliament and of the Council of 23 October 2019 on the protection of persons who report breaches of Union law.

03. How can I communicate information?

You can submit a communication using the form available for this purpose on the entity's website. You'll find it in the top bar of this page, under the "communicate information" tab.

04. How can I track a piece of information?

Once you have filled in the form to file a communication, the platform will provide you with a reference code that you must save. With this code and the password you generate, you will be able to access the "Check processing status" tab on the bank's website whenever you want and from any device.

If you have identified yourself when you file the communication, every time there is a new development in the investigation you will receive a message that will indicate it. On the other hand, if you have filed the complaint anonymously, you must be the one who proactively accesses the platform to be able to consult the actions carried out and answer the requests that the channel manager may have made to you.

05. Is it possible for the person communicating information to remain anonymous?

Yes. With the entry into force of Law 2/2023, regulating the protection of people who report regulatory and anti-corruption violations, it is mandatory to provide this option to people who want to report information. The form for submitting a communication contains a section where the informant is asked if he/she wants to maintain anonymity, if so, all fields on personal data automatically disappear.

If, on the other hand, the reporting person identifies themselves when submitting a communication, their data will be processed in accordance with the provisions of current data protection regulations, so that identification can be carried out with total guarantee and confidentiality.

06. Is the person affected by the communication informed?

Yes, Law 2/2023 provides that the person involved in the facts that are the subject of the investigation has the right to intervene in the procedure initiated from the communication (art. 19). However, she will only be informed of the facts of which she is accused, but in no case of the person who has communicated the facts.

07. Who can use this information channel?

This information channel can be used by any person related to the entity, who has obtained information that may constitute an infraction or crime in a work or professional context. The specific list of the people to whom this channel is aimed can be found in the "Regulations for the Operation of the Information Channel", available on the entity's website.

08. Who receives the information that is interposed through this channel?

The manager of the channel designated by the entity, which is identified in the "Regulations for the Operation of the Information Channel" available on the entity's website.

09. What types of communication can be presented through the information channel?

The communications that can be made through the channel are those provided for in article 2 of Law 2/2023, of 20 February, developed in European Directive 2019/1937, that is:

10. Is any communication investigated?

No, once a communication is filed, the channel manager will study it and may close the procedure, always in a reasoned manner, if it considers that the communication filed is not the subject of any infringement, lacks veracity or is not sufficiently justified.
